Divorce Laws in Texas

In Texas, for a spouse to file for divorce (also known as the petitioner), he/she needs to file a Petition for Divorce with his/her county’s district court. The petitioner also needs to give legal notice to the other spouse. The other spouse (referred to as the respondent), has to file an answer to his/her district court within 21 days or it may become possible to complete the process without the cooperation or consent of the respondent. Generally, there is a 60-day time limit from the date the Petition for Divorce is filed before a final judgment can be made. However, this time limit may be waived if there is just cause, such as a domestic abuse conviction.

A divorce may be granted for any of the following reasons:

  • Adultery
  • Abandonment for a minimum of one year
  • If the spouses did not live together for a minimum of three years
  • If a spouse committed a felony and has been imprisoned for a minimum of one year
  • If one spouse committed cruelty to the other that rendered the marriage irreparable
  • If one spouse has been in a mental hospital for a minimum of three years and his/her condition does not look to improve
  • If the marriage has become irreparable due to conflict of personalities or discord that destroyed any chances at reconciliation
